ELISABETH YORK Sales Terms
At ELISABETH YORK, we believe that our customers should not only enjoy luxury merchandise, but also a luxury shopping experience. We value the key role of retailers in increasing brand exposure, and feel that upholding the high standards of the ELISABETH YORK brand is of foremost importance.
Terms of Sale:
- Approval to sell at your brick and mortar location does not guarantee your approval as an online retailer
- To request approval please submit your completed ELISABETH YORK Online Retailer Application to sales@elisabethyork.com. Your application will be reviewed by a panel.
- Wherever an ELISABETH YORK product is shown, the brand or logo must be shown for that item
- Retailer must offer current, non-closeout items at minimum advertised price not less than 2.5 x the regular manufacturer wholesale cost, or as posted by EY
- Sale through third party retailers (eBay, Amazon, Walmart.com, etc.), and/or any site not listed in and approved on your agreement is strictly prohibited
- If ELISABETH YORK announces a price adjustment on product, prices should be changed immediately to reflect the current regular wholesale prices
- Discounted items (A911 Status) are subject to MAP based on the new lower price
- Neither coupons nor discounts can bring the price below the minimum advertised price. Free product promotions bringing the price total below the retail pricing guidelines are also not allowed. If "bundling" groups of product, total MAP will be determined by adding the MAP for each item
- ELISABETH YORK products may not be included in sales, promotions, or coupons without prior written approval
- Retailers may not use the following verbiage to describe ELISABETH YORK merchandise: sale, discount, low prices, closeout, clearance, deal, priced below MSRP, or any version thereof
- All print and digital advertising must be approved
- Use of language that implies that the retailer is an "exclusive" or "sole" distributor for ELISABETH YORK products is prohibited
- Use of misleading language such as "largest selection" or language which implies that you are a storefront for ELISABETH YORK is prohibited
- Permission must be received to use any ELISABETH YORK product, logos, photography, brands, product names, or trademarks in advertisements. Permission will be granted by item or collection
Failure to honor these terms may result in suspension or permanent cancellation. Terms subject to change. Any notification of changes will be sent to all active accounts via email.
ELISABETH YORK Internet Sales Terms
At ELISABETH YORK, we believe that our customers should not only enjoy luxury merchandise, but also a luxury shopping experience. We value the key role of online retailers in increasing brand exposure, and feel that upholding the high standards of the ELISABETH YORK brand is of foremost importance. Therefore, the online sale of our product is extremely limited. All retailers approved to sell ELISABETH YORK product on the internet must adhere to the ELISABETH YORK internet pricing policy to remain an authorized EY dealer. Retailers requesting to sell ELISABETH YORK online are evaluated based on the criteria listed below.
Criteria:
- Brand enhancing exposure on the site for the ELISABETH YORK brand
- Existing high-end or luxury brands currently offered on the website
- Style and user experience of the website
- Dedicated brand pages
- MAP history
- Retailer type
Terms of Sale:
- Approved online retailer application. Approval to sell at your brick and mortar location does not guarantee your approval as an online retailer
- All web materials and sites must be approved, and will be reviewed regularly
- Wherever an ELISABETH YORK product is shown, the brand or logo must be shown for that item
- Retailer must offer current, non-closeout items at a minimum advertised price not less than 2.5 x the regular manufacturer wholesale cost, or as posted by EY
- Sale through third party retailers (eBay, Amazon, Walmart.com, etc.) and/or any site not listed and approved on your agreement is strictly prohibited
- Internet prices should immediately be changed to reflect the current regular wholesale prices if a price adjustment on product is announced by ELISABETH YORK. Retailers will be asked to submit lists (in Excel format, by ELISABETH YORK item number or UPC) of all product/photos offered on ther internet for approval and regular review
- Discounted items (A911 Status) are subject to MAP based on the new lower price
- Neither coupons nor discounts can bring the price below the minimum advertised price. Free product promotions bringing the price total below the retail pricing guidelines are also not allowed. If "bundling" groups of product, total MAP will be determined by adding the MAP for each item. Shipping charges remain at the discretion of each retail site
- ELISABETH YORK products may not be included in sales, promotions, or coupons without prior written approval
- Retailers may not use the following verbiage to describe ELISABETH YORK merchandise: sale, discount, low prices, closeout, clearance, deal, priced below MSRP, or any versionof that thereof

Use of Branded Terms:
- Use of branded terms with no modifiers in targeted keywords or ad copy is permitted. However, bidding for the #1 position on branded terms is prohibited
- Photography Release Guidelines for C&F Enterprises apply to the ELISABETH YORK brand. Logos are available upon request through Customer Service.

Order and Delivery Terms and Conditions:
- Net 30 days, subject to credit approval. A 1.5% service charge will be added to all past due accounts.
- Elisabeth York accepts Visa, MasterCard, and American Express.
- Elisabeth York will accept COD with a 25% deposit for new accounts. FOB Newport News, VA.
